  if so, what actually happens to someone if they have had the cops called on them for animal cruelty?
if i child does something intentionally cruel that is excessive, the person responsible for watching the child at the time the incident occurred would be responsible ... the parents should be less concerned about responsibility because little kids who are intentionally and seriously cruel to animals, especially at a young age, and the behaviour is not being being modeled, that is an indicator the child has psychological problems that could lead to psychosis later in life ...
In most places a parent or adult in charge would have some responsibility legally. However, this is a way more serious problem than who bears legal responsibility and what a penalty might be. A 5 year old who abuses animals needs immediate and intensive mental health help. Animal abuse is a very common precursor to all sorts of antisocial behavior including spousal abuse, child abuse and other sociopathic behaviors. Either the police or family services/child protective services needs to be called AT ONCE!
It will depend upon the laws in your state. Some states make parents responsible. Some make them responsible ONLY for the willful misconduct of the child and some do not hold parents responsible at all.

Depending on the age of the child. If the child was older (But still underage), the child will be held responsible. If the child is younger, the adult would be responsible. Depending on what type of cruelty, the parent will be charged with cruelty or if the child is older, they will be charged cruelty.
It should depend on the laws independent to where you live. Normally, it is the same as any crime committed by a child. When young enough, the parent is responsible, but when old enough to be considered a juvenile offender, the parents are not to blame legally.

Like I said before, depending on what the child did to the animal, would also depend on what happens. Most likely, if it was bad enough, the parent and/or child would go to court.
